Privacy Policy

We at Air Education, Inc, d/b/a Air Reading, (“Air Education”, “we”, “us”, or “our”) care about the privacy of our users (“user(s)”, “you”, “your”).  This privacy policy (“Privacy Policy” or “Policy”) explains the personal information we may collect, use, disclose or otherwise process from you and should be read together with our Terms of Service (“Terms”). 

By accessing and using our online programs and services, including live sessions (“Course Services”), website(s), and web applications (all together referred to as “Services”) or contacting us through Services, email, text messages or other means indicated on the Services, you acknowledge that (i) you are an adult at least 18 years of age, (ii) have read and understood the terms of this Privacy Policy, and (iii) consent to us collecting, using, disclosing and/or processing your and your children or student’s personal information for the purposes described in this Policy. If you do not consent to the collection, use, and/or disclosure of your and your children or students’ personal information as described in this Privacy Policy, you may, where applicable, refuse the collection of certain information by selecting the appropriate settings on your browser or device where collected by cookies or similar means, or cease your use of the Services.

The Services may be used by families, children, parents and legal guardians (“parents”, “legal guardians”, “users”, “you”) for educational purposes of your child(ren). 

The Services may be used by educational organizations, such as schools, school districts, teachers, school staff, after-school programs or preschools (collectively referred to as “schools”, “school teachers”, “school personnel”, “users”, “you”), for educational purposes of your students. 

The children of parents or legal guardians and students of schools who sign up for Services are collectively referred to as “Air students”.

The Services are also used by those that we contract to teach in our Services (“Air coaches”).

I. INFORMATION WE COLLECT

Air Education collects information in several ways from different parts of our Services.

A. Information You Provide To Us

School Information –  When a school teacher, administrator or other authorized person associated with a school (each referred to as “school personnel”) registers for or inquires about Services, we may collect personal information such as school personnel name, phone number, e-mail address, payment information, Service username, Service password and other relevant information about the school personnel and school.

Student Information –  Once registered, school personnel may provide information about the schools’ students, such as student names, other identifiers, demographic data and academic performance information. This information collected about students together with other information collected from students, such as video recordings of Course Services and ’usage data of the Services, are “Student Data.”

Parent or Legal Guardian and Child Information – When a parent or legal guardian registers for an account on our Services or corresponds with us, we may collect personal information such as name, phone number, e-mail address, payment information, Service username and Service password. We may also collect information about the child(ren) authorized by you to use the Services through the account, including name and birth date.

Air coaches – Those who wish to be contracted to teach through our Services may apply for an Air coach account and provide us with personal information such as name, phone number, address, e-mail address, bank account information, social security number, government ID, Service username and Service password. We may also collect information about your teaching experiences, credentials and criminal background, and collect a photo image of you and audio and/or video samples of your teaching.

B. Automatically Collected Internet Activity and Usage Information – Like most websites and online services, we may automatically collect certain types of usage and/or technical information when you access our Services or communicate with us. This information is typically collected through a variety of tracking technologies, such as cookies, web beacons, log files and similar technology, and we may use third-party providers to collect this information on our behalf. These tracking technologies collect information about how you access and use our Services, information about your browser and device (e.g. Internet Protocol, browser type, device type, a unique ID that allows us to uniquely identify your browser, device or account) and logs of your usage history of the Services. We may also collect the geographic location of your devices at the city level.

We use the data collected through tracking technologies to secure the Services, provide and improve our Services, save you time, provide better technical support and to track website usage.

Most browsers are initially set up to accept cookies, but you can reset your browser to refuse cookies or to indicate when a cookie is being sent. However, some features and Services may not function properly if cookies are disabled, particularly those that require you to sign in.

C. Categories of Personal Information We Collect

Identifiers – of parents, legal guardians, school personnel, Air students and Air coaches.

Sensory Data – Photographs and video recordings of Air students and/or Air coaches (and anyone who may walk into the recording) taken in connection with our Course Services. The purpose of the recordings is for us to monitor the performance of Air coaches and the safety and security of our Services. The photographs and recordings will be kept strictly confidential and will only be used for internal purposes.

Demographic Data – Such as an Air student’s reading level, grade level, learning disabilities or needs, family socioeconomic background to the extent provided by a school, parent or legal guardian.

Commercial Information – records of Services purchased and/or considered.

Financial Information – payment information used for purchase of Services and bank account information for payments to Air coaches.

Communications Data – When you communicate with us with questions or requests for customer support through emails, text messages or telephone calls, we collect the content provided during those communications, including metadata such as the time and contact info.

Automatically Collected Technical Information and Internet Activity and Usage Information – as described in section B. above.

D. Sources From Which We Collect Your Personal Information

From Parent/Legal Guardian, Schools and School Personnel –  we collect personal information about yourself, about the children and students who participate in our Services and about Air coaches provision of Course Services. 

From Air coaches – we may receive personal information about yourself and your Air students from lesson feedback.

Third-Party Integrations – If you create an account or sign-in through a third-party service, such as Google, we may collect information about you from the third-party service.

Tracking technologies are used to automatically collect technical information, Internet activity and Services usage information as described in section B. above.

Recording technologies, such as Zoom and Google Meet third-party providers, are used to collect video recordings of you during Course Services with consent to the extent required by law.

Background check providers may be used to collect background check reports about Air coaches in accordance with applicable law.

II. HOW WE USE THE INFORMATION WE COLLECT

A. To provide, maintain and improve our Services. For example: 

  • Verify your identity, register and maintain your account, including where you register for an account or log in to our Services using online third-party services such as Google Sign-In.

  • Process and maintain records of your orders, payments and transactions made by you.

  • Provide our Services to you.

  • Analyze and improve our Services, monitor the effectiveness of our Services, detect usage patterns and fix any technical issues, customize existing and future Services pursuant to our legitimate interest.

  • Communicate with you regarding your use of our Services.

  • Perform our obligations and internal operations of providing and maintaining our Services.

For Air coaches, we may use the information we collect to provide Services as above and also including but not limited to the following:

  • Verify your background, qualifications, credentials, certificates, permits that you have obtained for teaching.

  • Carry out our obligations arising from any contracts between you and us.

B. To market our Services. We may send marketing information to you about our Services. You can opt-out at any time by using the unsubscribe link included in our communication or contacting us directly at support@airreadingclass.com. Such communications are only sent to parents, legal guardians, schools, school teachers and Air coaches, not to Air students. We also use information to monitor the performance of our contextual advertisements and marketing efforts.

C. To promote safety, security and compliance

For example:

  • Protect our Services from security threats by authenticating users, detecting and preventing fraud or abuse of Services.

  • Storing and backing up the Services.

  • Enforce our terms and policies.

  • Protect the rights, property and safety of Air Education, you and others.

  • Report suspected criminal conduct to law enforcement or cooperate or assist in law investigations or enforcements conducted by a governmental or regulatory authority.

  • Comply with any applicable laws, regulations, codes of practice, guidelines or rules.

  • Exercise our rights under applicable law and to support any claim, defense, or declaration in a case before a jurisdictional, administrative authority, arbitration or mediation.

III. HOW WE MAY SHARE THE INFORMATION WE COLLECT

We generally maintain the confidentiality of your personal information. However, we may have a legitimate business need to disclose and share your personal information to one or more of the categories of external recipients for one of the purposes listed below:

  • Air coaches – We share certain information of Air students, including first name and initial of last name (though parent, legal guardian or school may include the last name at their option) and reading level assessment, with the Air coach teaching each Air student. Air coaches do not have access to the email addresses of the Air students’ parents, legal guardians or school personnel.

  • Aggregated or de-identified information – We may share information in aggregated and/or anonymous form that cannot reasonably be used to identify an individual for marketing and sales, research and other lawful purposes.

  • Legal Obligation and Compliance – We may release information if we have a good faith belief that access, use, preservation or disclosure of such information is reasonably necessary to 1) satisfy any applicable law, regulation, legal process or enforceable government request; b) enforce applicable Terms of Service, including investigation of potential violations thereof; c) detect, prevent or otherwise address fraud, security or technical issue; d) protect the rights, property, or personal safety of Air Education, its users, or the public; or e) as required or permitted by law.

  • Change of control or sale - In connection with a corporate transaction, sale or assignment of assets, merger or other change of control of Air Education, your information may be transferred or disclosed. In such an event, we will make efforts to provide notice before personal information is transferred and becomes subject to a different privacy policy.

IV. NO SALES OF PERSONAL INFORMATION

We do not sell your personal information.

V. DATA STORAGE AND TRANSFER

Air Education is located in the United States. Information collected through our Services are stored and processed in the United states or any other country in which our service providers may maintain facilities. If you reside outside of the United States, you agree to your information being transferred to the United States where it will be processed and stored in accordance with this Privacy Policy.

VI. MANAGING YOUR INFORMATION

You may access and edit your account information by signing into your account. If you are a parent or legal guardian of a student who uses the Services through a school, please refer all questions and requests regarding access, modification and deletion of your student’s information to your child’s school. The school, may, at its discretion, address such requests with us and we will respond promptly to all such requests we receive from schools.

For non-school users, please contact us at support@airreadingclass.com about deleting your account or personal information. We may not be able to comply with your request in all circumstances. For example, requests relating to information associated with a school account may be subject to approval by the school. When account information is deleted or de-identified, certain residual information may remain within our archive records, such as for customer and technical support, billing and tax purposes.

We will retain your personal information for as long as needed to provide the Services and for our internal business purposes, which may extend beyond the termination or cancellation of your account. For example, we may retain certain data as necessary to prevent fraud or future abuse, for recordkeeping or other legitimate business purposes, or if required by law. We may also retain and use information which has been de-identified or aggregated such that it can no longer reasonably identify a particular individual. All retained personal information will remain subject to the terms of this Privacy Policy.

We will not knowingly retain Student Data beyond the time period required to support an educational purpose, unless authorized by a school. We do not delete or de-identify any Student Data from an active account associated with a school except at the direction of the school. The school is responsible for maintaining current student rosters and identifying Student Data which the school no longer needs for an educational purpose by removing students from the school’s roster or by submitting a deletion request to support@airreadingclass.com.

Unless otherwise directed by a parent, legal guardian or school, we will delete or de-identify personal information of Air students after a period of inactivity or after the termination or cancellation of the account.

VII. SECURITY

The security of your personal information is important to us. We seek to use reasonable organizational, technical, physical and administrative measures to protect the information collected and protect against unauthorized access.  However, no security system can prevent all potential security breaches. If personal information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and take all steps required by applicable laws and regulations and our agreements with any affected schools and use reasonable efforts to contact you through the contact information you have provided us when appropriate.

Maintaining the security of your personal information also requires your cooperation and involvement. For your protection, remember to sign out of all accounts before closing your browser. Please keep your password secure.

If you have any concerns about the security of your account or our Services, please report your concern to us immediately. 

VIII. INFORMATION OF CHILDREN

Air Education does not permit anyone under the age of 18 to create an account and does not knowingly collect personally identifiable information from children under the age of 13 without the consent and the direction of a parent, legal guardian or school. Please contact us if you believe we have inadvertently collected information from a child under 13 without parental or school consent so that we may delete the information as soon as possible.

Parents, legal guardians and schools who create an account and subscribe to our Services may set up an Air student profile(s) associated with the parent or school account so that children under 18 may access the Services under a parent, legal guardian or school supervision. Parents and legal guardians consent to our collection, use and disclosure of information collected from their children’s use of Services, including video recordings of courses in our Services as described in this Policy. 

When used by a school or educational setting, the school authorizes Air Education to collect, use and disclose information from a child under 18, including video recordings of courses in our Services. Our collection, use, and disclosure of Student Data is governed by the Privacy Policy, and/or any other agreement with the school, by the provisions of the Family Educational Rights and Privacy Act (“FERPA”), the Children’s Online Privacy Protection Act (“COPPA”) and any other applicable laws that may relate to the collection and use of personal information of students.

IX. NO ADVERTISING

We do not display any advertisements in our Services and do not do any targeted advertising.

X. THIRD-PARTY WEBSITES

Our Services may contain links to and from third-party websites of our business partners and social media sites. If you follow a link to any of these websites, please note that these websites have their own privacy policies and their practices are not covered by this Privacy Policy. We are not responsible for the privacy practices or the content on the websites of third-party sites.

XI. CHANGES

We may from time to time modify or update this Privacy Policy which will be reflected in the “Last Updated” date set forth at the beginning of this Policy. If we change this Policy in a material manner, we will do our best to notify you of the changes by posting a notice on our website or through other appropriate communication channels. Your continued use of the Services following the effective date of such update constitutes your acceptance of the revised Policy. If you do not agree to any of the terms in this Policy or to any future terms in a future update of this Policy, do not use or access the Services.

We will not make any material changes to our Privacy Policy or Terms of Service that would result in Student Data being used in a materially different manner than was disclosed when the information was collected without first giving notice to the applicable schools and providing a choice before such Student Data is used in a materially different manner than was disclosed when the information was collected.
